Regulations of the Lifelong Learning Program Erasmus

I. GENERAL

Art. 1
Regulations of the Lifelong Learning Program Erasmus, hereinafter referred to as the Regulations, apply to all matters related to participation in the international student exchange projects under LLP Erasmus.

Art. 2
The Regulations constitute an elaboration of provisions set down in the Erasmus Student Charter.

Art. 3
§1 Erasmus is a Programme for Union action under the Lifelong Learning Program, addressed to institutions of higher education.
§2 The main objective of LLP Erasmus is to improve the level of education and foster the European dimension of higher education studies, notably through increased learning mobility opportunities, strengthened cooperation between higher education institutions, as well as international student and staff exchange in Europe.

Art. 4
§1 European Credit Transfer System (ECTS) is a system designed to facilitate recognition of study attainment and performance of students between institutions of higher education across the European Union.
§2 The System sets down a standard of ECTS credits based on the workload needed by students to achieve expected learning outcomes. Thirty (30) ECTS credits are typically attached to the workload of one semester of formal training.


II. CRITERIA OF PARTICIPATION

Art. 5
§1 Students applying for participation in the exchange program are required to fulfil all the conditions set down below:
1) completion of the first academic year course at home university;
2) citizenship of any country in the world is recognized as eligible – no limits apply in this respect;
3) passing grades in all subjects and good command of the working language used at target institution of higher learning;
4) for study exchange programs – no past record of participation in similar projects under LLP Erasmus;
5) for traineeship exchange programs - no past record of participation in similar projects under LLP Erasmus.

§2 Participation in LLP Erasmus exchange programs is open to:
1) students of institutions listed under the Erasmus University Charter offering student exchange programs;
2) students of higher education courses of any degree: bachelor, engineer, master and doctor.

Art. 6
Students participating in the program are required to have individual insurance policy for the whole period of studying abroad.

Art. 7
§1 Students on extended leave of absence are not eligible for participation in the LLP Erasmus.
§2 Students on extended leave of absence may apply for participation in the LLP Erasmus, provided that the exchange takes place during his or her normal course of studies (after the time of extended leave has passed).

Art. 8
§1 Students on course retakes can neither take part in the recruitment procedures nor go on exchange programs under LLP Erasmus (even if already qualified for participation).
§2 In the case of students leaving for exchange programs despite being rendered ineligible under the conditions set down in §1 above, the home university reserves the right to take punitive measures, including refusal of formal recognition of the courses taken abroad, study discontinuation and reimbursement of any student grants already received.
§3 Any problems, particularly in respect to timing conflicts and overlaps of exchange projects with dates set down for examination periods, will be resolved by respective Deans in agreement with appointed project coordinators.

III. SCHOLARSHIP STUDIES

Art. 9
§1 Studies abroad within the LLP Erasmus program are organized for the duration of one or two academic semesters.
§2 Students may not apply for extension of the exchange program from spring to autumn semester (the period of studies abroad will not extend beyond the duration of a single academic year).
§3 In the case of studies abroad extended from autumn to spring semester – duly agreed upon by both home and receiving institutions and after endorsement of the Learning Agreement to cover for extended period of study – the student will be granted an extension of scholarship, in accordance with regulations set down by home institution.

Art. 10
§1 Studies abroad within the LLP Erasmus are free of charge; the receiving institution is legally obliged to waive any tuition fees that may apply to beneficiaries of the program.
§2 Every student participating in the program will receive additional funds for partial coverage of travel, accommodation and any other expenses that may apply in relation to the exchange program.
§3 The volume of scholarship granted will be determined based on the distance to receiving institution, the number of participants and the amount of funds made available to home institution by the National Agency of LLP Erasmus.

Art. 11
Participation in the scholarship program does not restrict the beneficiaries’ right to work abroad.

Art. 12
Participation in the LLP Erasmus program shall in no way preclude the beneficiary from any other pre-existing or pending scholarship and grant privileges agreed upon by home institution.

Art. 13
§1 Students will reserve the right to terminate the scholarship program under ‘force majeur’ conditions, in particular: natural disasters, war conflicts and random life incidents of individual character.
§2 The academic status of beneficiaries choosing to terminate the scholarship program will be decided by proper Dean (head of appropriate department).

Art. 14
The language of tuition will be of no concern for the purpose of formal recognition of ECTS credits received for the period of exchange, and will be disregarded by Deans and project coordinators of home institution in the recognition procedures.

IV. PROGRAM DOCUMENTATION

Art. 15
§1 Learning Agreement regulating the learning program, signed prior to participation in the program, shall preclude the beneficiary from formal obligation of passing the academic content for the semester/academic year spent abroad.
§2 Recognition of the time spent on scholarship shall be decided by LLP Erasmus program coordinator and proper Dean, based on Transcript of Records provided by the receiving institution, and will take form of formal recognition of ECTS credits received by the beneficiary.
§3 The LLP Erasmus coordinator reserves the right to deny transfer of ECTS credits received during the course of scholarship program if such credits are found in default of study requirements as set down for the respective study specialization at home institution.

Art. 16
§1 Learning Agreement shall not include obligatory courses of non-interchangeable content, required by home institution during the respective academic year/semester. Realization of such obligatory courses in receiving institution shall be considered valid only if approved by proper examination body of home institution.
§2 To receive credit for academic year/semester spent abroad, students are obliged to make up for any differences in content, duration and ECTS credit that may result from their participation in the program.
§3 Exchangeable courses shall be replaced by courses offered by receiving institution, based on similarity of learning content and study fields covered.

Art. 17
Master and doctoral seminars, regarded as obligatory courses, may be completed abroad only if properly agreed upon on individual basis by proper thesis supervisors.

Art. 18
§1 Learning Agreement shall cover a minimum of 15 ECTS credits per semester or 30 ECTS credits per academic year, respectively.
§2 Maximum number of ECTS credits recognized during the time of study abroad shall be 40 per semester, and 80 per academic year, respectively.
§3 The number of ECTS credits to be recognized during the time of study abroad will be decided by LLT Erasmus program coordinators of proper departments, since it directly relates to learning requirements set down by home institution per academic year/semester.

Art. 19
§1 Students are required to submit to proper Dean a Learning Program Agreement, detailing the courses planned for realization at the receiving institution and, in addition, a list of exchangeable home university courses that the student elects to get credit for as replacement.
§2 Based on the Learning Program Agreement, students are required to specify any course differences that may result from program participation and take up the obligation to get credit for such differences during the next academic year/semester at home institution.

Art. 20
§1 Any changes to the approved Learning Agreement shall be provided in the Changes to Learning Agreement form within two weeks after the starting date of the semester they apply to.
§2 The content of the Changes to Learning Agreement form require approval on the part of program coordinators of both partnering institutions.

Art. 21
§1 Recognition of courses covered during the period of study abroad under LLT Erasmus will be based on Transcript of Records, listing all courses participated by the beneficiary at receiving institution, together with the corresponding ECTS credits and marks received in accordance with both ECTS regulations and formal regulations set down by receiving institution.
§2 Transcript of Records, listing credits for courses already covered by the student at home institution, may also be required by the receiving institution for the purpose of determining eligible courses to be received abroad. In the case of such requirement being expressed by the receiving institution, students are obliged to prepare such transcript on individual basis, supplementing it with applicable formal evaluation marks, examination results and ECTS credits received.

Art. 22
§1 After returning from their stay abroad, students are obliged to submit to the proper Dean a written Application for recognition of course content realized abroad.
§2 To receive formal credit for the semester spent studying abroad, students are obliged to make up for any differences in the learning content (or to get approval for realization of the missing content at a later date, following conditional promotion).

V. TRANSFER OF CREDIT RECEIVED ABROAD

Art. 23
§1 ECTS credits received abroad for language courses will be recognized only if they correspond with similar courses planned for the semester at home institution.
§2 If original learning program at home institution does not cover for language courses, credits for language courses received abroad will not be subject to transfer.
§3 Failing to receive passing grades on courses at receiving institution shall oblige the student to obtain such passing grade at home institution, regardless of any surplus credit received otherwise and regardless of the number of ECTS credits attached to such course.
§4 The manner of passing a course failed abroad will be decided by the proper Dean, in agreement with the department coordinator.

Art. 24
Surplus ECTS credits received abroad may be transferred to cover for selected future courses at home university, as planned for the consecutive academic year/semester, following a letter of application presented to the proper Dean. Such courses will be recognized as passed with proper credit.

Art. 25
Any abroad courses which are deemed similar to the learning content already covered by the student at home will not be recognized. Any doubts in this matter will be ruled by the department coordinator.

VI. OTHER PROVISIONS

Art. 26
Any matters not provided for in these Regulations shall be governed by study regulations of the home institution and subject to proper appeal procedures.

Art. 27
Students participating in the LLP Erasmus program declare their knowledge of these Regulations.

Art. 28
These Regulations shall enter into force on the date of commencing of the academic year 2013/2014.
